To be vague since it’s not me but my grandmother. Life insurance paperwork was never changed so after my grandfather passed the paperwork went to his ex wife since her name was on it. My grandmother his legal wife can’t get the paperwork until she (the ex wife) send the paperwork back.
Long story short what is the best way to continue the process?
It happens quite frequently. Unfortunately, the insurance company can only work with and pay the person listed as the beneficiary. I hope you and your grandmother will receive fair treatment from your ex-wife.
Lawyers have confirmed that the money legally doesn’t belong to her, both in her state and my grandmother’s. They say they just need to wait for her (the ex) to send the packet to the insurance company before my grandmother gets her own packet. Since she has the packet and her name is on it, does that mean she can still cash it, or would it be fraud if she tries? I really appreciate the feedback!
If the ex-wife is still listed as the beneficiary, she will receive the policy proceeds. That’s why it’s crucial to update beneficiaries after major life changes.
